PUBLIC OFFER AGREEMENT FOR INFORMATION SERVICES

1. GENERAL PROVISIONS
1.1. This Public Offer Agreement (hereinafter — the “Offer” or “Agreement”) represents the official proposal of the Service Provider on the website https://elenatroian.es/ to provide Information Services to legal entities and/or legally capable individuals (hereinafter — the “Customer”) under the conditions listed below, by providing information through text, video, photo, or audio lessons/messages — a special form of information delivery aimed at acquiring additional knowledge, skills, and competencies by the Customer using particular methods chosen at their discretion.
1.2. Acceptance of this Offer constitutes the Customer’s full and unconditional agreement with all terms herein without exceptions or limitations and, in accordance with the laws of Ukraine, is equivalent to concluding a bilateral written agreement on the terms described in this Offer.
1.3. This Public Offer for the provision of Information Services is considered concluded (accepted) from the moment the Customer’s payment is received by the Service Provider.
1.4. Both the Service Provider and the Customer guarantee their legal capacity and authority necessary for concluding and executing this Agreement.

2. DEFINITIONS AND TERMS
2.1. The following terms are used in this Offer with the meanings indicated:
  • Offer — this Public Offer Agreement for the provision of Information Services.
  • Website — https://elenatroian.es/en/oferta, owned and operated by the Service Provider.
  • Information Services — any services of the Service Provider, the types and cost of which are specified on the Website, providing the Customer with limited access to the Website, closed channels for receiving materials, including participation in themed marathons in the form of recorded or live multimedia courses, trainings, or marathons, and related informational services such as consultations through secure VoIP software or other forms determined by the Provider.
  • Acceptance of the Offer — full and unconditional acceptance of the Offer by making 100% prepayment for the Information Service.

  • Customer — a person who has accepted the Offer on the terms set forth herein.
  • Information Services Agreement (the “Agreement”) — an agreement between the Customer and the Service Provider concluded through acceptance of this Offer.

3. SUBJECT OF THE OFFER
3.1. The subject of this Offer is the paid provision of Information Services by the Service Provider to the Customer in video, photo, audio, or text format for a fee.
3.2. The cost of each type of Information Service is specified on the Website. The Agreement is considered concluded upon receipt of payment by the Service Provider.
3.3. Payments can be made by any method offered on the Website, including:
  • electronic money;
  • payment via terminals or internet banking;
  • bank transfer to the Service Provider’s account;
  • payment through authorized agents (individuals or legal entities);
  • other methods agreed in advance with the Service Provider.

4. TERMS OF PROVIDING INFORMATION SERVICES
4.1. The Service Provider grants the Customer limited access to the Information Service hosted on secure platforms.
4.2. Types and payment methods for each Information Service are specified on the Website.
4.3. Purchase of materials is confirmed by submitting a request and making payment using the “Pay” button on the Website.
4.4. If the Customer does not receive access within 2 business days, they must contact support at elenatroian.site@gmail.com.
4.5. The Service Provider undertakes to provide the Information Service within 2 business days after receiving payment.
4.6. This Offer serves as proof of service provision; no additional service act signing is required.
4.7. The Service Provider reserves the right to revoke access if the Customer shares paid or free materials with third parties. Services are for personal use only.

5. RIGHTS AND OBLIGATIONS OF THE SERVICE PROVIDER
5.1. Provide 24/7 access to paid materials (text, video, audio, photo).
5.2. Ensure confidentiality and proper processing of the Customer’s personal data.
5.3. Provide accurate and complete information about services upon request.
5.4. The Service Provider may unilaterally change the Offer terms by publishing updates on the Website no later than 5 calendar days after changes.

6. RIGHTS AND OBLIGATIONS OF THE CUSTOMER
6.1. Provide accurate information during registration and ordering.
6.2. Use materials only for personal purposes; do not copy, sell, or redistribute.
6.3. Maintain technical equipment and internet connection. The Provider is not responsible for failures outside its control.
6.4. Enjoy consumer rights under Ukrainian law.
6.5. Claims for poor-quality services must be submitted via elenatroian.site@gmail.com within 30 days. The Provider will decide on refund or refusal.
6.6. Refunds, if approved, are issued to the Customer’s account or other agreed method. Applications must include full account details. Refunds are processed within 30 calendar days from receipt of the signed application.

7. LIABILITY OF THE PARTIES
7.1. Parties agree to attempt pre-litigation resolution of disputes; otherwise, disputes may be submitted to a court.
7.2. Parties are liable for non-performance or improper performance under applicable law.

8. QUALITY GUARANTEES
8.1. The Customer accepts the risk of not gaining profit or incurring losses from using acquired knowledge and skills.
8.2. The Provider does not guarantee income or results; outcomes depend on the Customer’s personal qualities and effort.
8.3. Refund claims must be submitted within 3 calendar days of gaining access. Claims submitted after this period will not be considered.
8.4. Claims must be submitted at least 1 day before the expiration of the refund period.

9. FORCE MAJEURE
9.1. Parties are released from liability for non-performance due to force majeure events, including but not limited to: natural disasters, power outages, war, strikes, terrorism, or government actions.
9.2. Obligations are extended for the duration of such circumstances.
9.3. If force majeure lasts more than six months, parties shall negotiate alternative solutions in writing.

10. MISCELLANEOUS
10.1. The Customer confirms full understanding and unconditional acceptance of the Offer.
10.2. Unregulated cases are governed by applicable Ukrainian law.
10.3. Ukrainian law governs this Agreement.
10.4. Parties consent to the processing and storage of personal data necessary for executing this Agreement.
